Tiny Seller Takes Multi Billion Pound Company to Court for Breach of Contract

A Lesson Into the Extent of Corporate Greed in Today's Business World

-- In what is nothing short of a David versus Goliath classic a SME named Thermilate Technologies Limited (TTL) has filed legal action against a multi billion pound company; RPC Containers Ltd (RPC) in a petition dated 22nd December 2018, in what it describes as a case of poor product manufacturing resulting in huge losses and damages .

TTL is a local paint manufacturing company based in Brighouse, West Yorkshire; a micro entity with just 5 employees compared to the 25,000 employees of its multi billion pound packaging supplier RPC. The latter being a company supplying a multitude of multinational corporations including Arla, AkzoNobel - Dulux in the UK, BP, L'Oreal, Mars, Nestle, Philips, P&G and Unilever to mention a few against which it has filed legal action.

On the 14th April 2014, TTL employed the services of RPC for the production of empty paint cans. However, in what TTL say is a breach of contract on the part of RPC, TTL received delivery of a substandard product.

Serving both domestic and international markets with distribution as far as the UAE, TTL had to halt distribution whilst at the same time pay for the recall of antecedently sent out goods.

TTL claims that these undesirable actions caused it to suffer immense significant tangible losses and furthermore caused the company substantial intangible damage to their reputation with the brand name losing a significant amount of its goodwill and reputation, resulting in the loss of many valuable customers on a permanent basis.

This case, ostensibly one of corporate negligence, oddly enough with a written admission made by RPC s Quality Technician by his own volition in a letter dated 21st April 2014 but a nevertheless an ongoing refusal to compensate TTL; therefore TTL has been forced to turn to the court to seek recompense.

TTL is asking the court that RPC provide compensation for the multiple losses it has suffered, but to which RPC is obviously not ready to abide; rather is is busy undergoing the process of an outright acquisition in a 3.3 billion takeover bid by the Apollo Global Management Group, a $72 billion US based investment fund.

Serious questions arise whether RPC has acted disingenuously not only with TTL but with the Apollo Global Management Group by withholding crucial information regarding the outstanding litigation which could potentially jeopardise the progress of this acquisition and the effects that the Apollo Global Management Group may face from the fall out of the outstanding situation following that acquisition.
