A medical malpractice case building for more than five years was recently brought to a close in an East St. Louis federal court. The defendant in this case was the federal government in light of its funding of the medical facility where Clanton received medical care and was represented by Assistant U.S. Attorney Laura J. Jones.
The lawsuit was built on improperly charted lab results, inadequate treatment of high blood pressure and lack of patient education, among other shortcomings. Clanton first began showing signs of kidney disease in 2011. Afterward, his health declined significantly until late December, 2012 when he was rushed to Barnes-Jewish Hospital where he was found to be in hypertensive crisis. In 2015, he underwent a kidney transplant and remains on anti-rejection medications as well as immunosuppressants.
Following testimonies from both sides, U.S. District Judge Nancy Rosenstengel determined Nurse Denise Jordan failed to supply Clanton with proper education regarding his condition and its potentially life-threatening effects. Despite insisting she had fulfilled her duty of care, Jordan was unable to bring to mind any specific treatments or care instructions she had provided Clanton or identify him in the courtroom during the trial. Judge Rosenstengel described Jordan's testimony as "simply not believable" and ruled in favor of the plaintiff.
