T. Scott Jones, recently named one of Knoxville’s Top Attorneys, was the cover story for CityView Magazine’s July/August issue on “Fearless Advocates.” Mr. Jones, recognized as one of Knoxville’s leading defenders of the civil and criminal justice systems, was interviewed about the role of a trial attorney, and asked to weigh in on whether or not the justice system can remain strong if attorneys do not take cases to trial. —
“This court avoidance seems inconsistent with the operating principles by which we as attorneys are trained, and yet it has become part of the legal system reality,” Mr. Jones told his interviewer from CityView. “The opposing counsel has to believe that your lawyer is absolutely willing to split the ring ropes, step into the ring, and actually go 12 rounds. If they don’t think you have the will power or skill to actually try the case, then they are going to pay you substantially less than your case is worth. And, in the situation of representing the criminally accused, your client is likely to take a much longer sentence, or God forbid, one they don’t deserve at all.”
Mr. Jones went on to explain the importance of preparation, telling his interviewer that he makes hundreds of court appearances every year. If trial attorneys are going to be at the top of their game, they need to spend time in courtrooms, making their cases before judges. Without this preparation, he feels, attorneys will be woefully underprepared when they must take a case to trial, which could lead to a negative outcome for their clients.
