When asked for a comment, he said, “At the beginning of the month, the New York State Police reported a 15-20% rise in domestic violence cases, which is an unfortunate consequence of lockdown measures to stem the spread of COVID-19.”
Bienenfeld continued by saying, "All too often, the American public underestimates the severe repercussions brought about by a domestic violence charge in New York. And it's not too uncommon that in the judicial system an innocent person will be found guilty of a domestic violence charge."
One important fact that much of the American public overlooks, according to Bienenfeld, is the short-term consequences of a domestic violence allegation.
When asked to elaborate, he said, “Because New York has ‘mandatory arrest’ laws, police officers are required to arrest someone if there is reasonable cause to believe an act of domestic violence has occurred. And that reasonable cause can be as simple as the victim’s statement.”
"In other words, you could be accused of domestic violence once an accuser makes a statement, which could then lead to time in jail until the court date or a Temporary Order of Protection. What this all means is that you could effectively be cut off from your family or loved ones before the case is resolved," he said.
A domestic violence conviction comes with a criminal record, which can be difficult – if not impossible – to shake in several areas of life.
"One of these areas is professional life. It'll become a challenge to secure employment. If you were gainfully employed before being convicted, then your employer might let you go. Additionally, there’s a chance that your professional license could be taken away if the board that issued the license deems that your crime was serious enough,” he said.
Bienenfeld continued by saying, "Even if you are lucky enough to lock down a job after being convicted, you'll have a hard time trying to secure housing. Generally speaking, landlords are not willing to take on a new tenant with a criminal record."
Because a conviction is so detrimental, Bienenfeld mentioned that it's crucial to find the right person to fight a domestic violence charge.
