"Probate is the legal process that confirms the validity of a will after someone has passed away," Jinks explained. "If you've been appointed as executor, there are several important steps you must take to make sure probate proceeds correctly and efficiently."

The process begins with filing a petition to open probate with the appropriate court. "In Indiana and most other states, the executor must submit the will and petition to the probate court shortly after the individual’s passing," Jinks said. "Fortunately, courts usually provide standardized forms, which makes the filing process more straightforward."

As the founder of Jeff Jinks Law, Jinks emphasized that a probate judge will typically hold a hearing to validate the will and offer interested parties the opportunity to raise objections.

One of the executor’s key responsibilities is identifying and safeguarding all assets of the deceased. "Sometimes, individuals pass away without fully disclosing their assets," Jinks noted. "It becomes the executor’s duty to track down any hidden or omitted assets using documents like tax returns, insurance policies, and bank statements."

Executors are also required to notify known creditors and publish a notice to alert any unknown creditors. "This is often done by publishing an obituary or legal notice in a local newspaper," he added.

Next, estate funds are used to settle any outstanding debts and bills. Executors must also file final income tax returns for the year the deceased passed.

"After all obligations have been met, the executor must petition the court to distribute the remaining assets to the beneficiaries named in the will," Jinks said.

While this probate checklist outlines key steps, Jinks cautions that each estate is unique. "Executors should always consult with an experienced probate attorney for guidance tailored to the specifics of the estate they're handling."
