In the second episode of the network’s weekly series distinguished criminal defense attorney Michael Waddington and Noel Tipon, a former judge advocate for the United States Marine Corps, debate the issue.
The two attorneys discuss the increase in inexperienced lawyers that are now taking military cases and give tips on how to properly vet and select the best military defense lawyer.
Waddington, one of only two military lawyers in the USA who is a member of the prestigious American Board of Criminal Lawyers (ABCL), says, “A military defendant should always someone how many trials they have done as a criminal defense lawyer, as lead counsel. And then ask himself why he should put his life in the hands of someone who has only done 10 cases?”
Tipon, a managing partner of the Honolulu-based firm, the Bilecki Law Group, agrees: “A serviceman looking for a lawyer has to do his homework and ask an attorney some tough questions. How many cases they have taken to a successful jury verdict, for example. Have they been battle-tested in court?”
Both Waddington and Tipon point out that many attorneys seeking to represent service members misrepresent their years of experience as military attorneys because many of those years are spent behind a desk and not in the courtroom.
