In a recent episode of the Legal Insights podcast, Solomon Kanu, Managing Attorney at Kanu & Associates, P.C. in Phoenix, AZ, revealed what every immigrant needs to know if they fall into legal trouble.

When asked for a comment, Kanu said that what a lot of immigrants don't realize is that permanent residency comes with a set of conditions.

"It's only permanent residency to the extent that you behave well. If you commit little offenses here and there, the so-called permanent residency could get taken away from you.”

Kanu added that one of the most surprising offenses that could lead to losing permanent residency or deportation is getting a DUI, even if they are only a little bit over the legal alcohol limit.

“There are several classes of DUI. So, for instance, if you have a DUI and you’re driving with your children or minors in the car, that’s classified as a felony DUI, which is a big deal. Other classes of DUI include getting a DUI more than once in five years or a DUI while a driver’s license is suspended, which is an aggravated DUI.”

Kanu added that it's his job to explain to immigrants that they should be on their best behavior and "can't be involved with guns and drugs and child neglect or abuse and domestic violence."

Getting into such legal trouble, according to Kanu, could lead to removal proceedings, which are "proceedings in which a person’s permission to stay in the United states is being withdrawn and the government says that they have to go." Removal proceedings can occur for both permanent residents and non-permanent residents.

When asked what he has done for his clients during removal proceedings, Kanu said that he has helped his permanent resident clients cancel their proceedings so they keep their green cards with a warning never to do it again and his non-permanent resident clients adjust their status, which cancels the removal proceedings and allows them to stay in the country as legal permanent residents.

"This adjustment of status – which is the same thing as getting a green card – can change them from being a visitor to becoming a permanent resident. In other words, they could go from someone who is about to be deported to someone who is a permanent resident," he said.

He added that some of his clients have been in the courtroom where they are fighting removal and then hear that their status has been adjusted to permanent residence.


Kanu, who is the author of “The Immigrants Manual for Success in America,” said that one great way to stay out of trouble is to contact an immigration attorney early on.

“One of the allies you have is a good lawyer who has succeeded and who can pass on the traits of success to you.”
