When asked to comment Hershman said, "Many parents are justifiably overwhelmed after learning their underage child has been charged with drug use or drug possession, but there are common pitfalls to avoid if they are about to take on the juvenile criminal system."
He said: "Firstly, it's critical to advise kids not to speak with police officers alone and without a lawyer in the room. Parents may not realize that if a child unknowingly waives their right to remain silent, they can be interrogated without parents or counsel.”
Hershman added that a teen might accidentally incriminate themselves without an attorney, which could potentially derail a robust and strategic defense case.
"So speaking to law enforcement without legal representation present is one of the biggest errors that can be made.
Remember, minors who are taken into custody have the right to a legal representation during a law enforcement interrogation."
The attorney emphasized: "The juvenile justice system is an entirely different animal from the adult justice system, meaning that you should hire an attorney who can expertly move through the juvenile justice system."
According to Hershman, the best thing to do is to hire an attorney who has a proven high success rate in similar cases.
"While parents are likely to be distressed and hastily choose the first attorney they come across to help with their teenager's drug charge, they should slow down and hire legal representation with relevant experience.
