When asked to comment, McMahon said, “A hostile divorce process can be traumatic not only for the parents but also for the children. Likewise, amicable divorces can benefit everyone involved.”
In the interview McMahon pointed out that one of the most important things anyone can do to minimize damage during a divorce is to remain calm.
“A lot of people have difficulty controlling their emotions as they go through something as life-changing as a divorce. One way to keep your feelings in check is to consult a professional therapist who can help you process your emotions and keep them out of the courtroom,” McMahon said.
McMahon added that introducing unwanted emotions into the divorce can make the process counterproductive and add to attorney fees.
“In my experience, the best way to finalize a divorce is if both parties cooperate with each other. Something you can do is brainstorm all possible solutions concerning child-sharing responsibilities and finances that are fair to both you and your spouse,” he commented.
He also alluded to the fact that transparency is paramount.
When asked to elaborate, McMahon said, “You will be asked to provide a substantial amount of information of a personal and financial nature, particularly through ‘discovery.’ It’s crucial that you are as truthful as possible when asked about your debt, spending habits, and assets.”
“If other information is uncovered, such as an affair or secret bank accounts, then the divorce will probably veer off into a different direction, again adding to the cost. For instance, your spouse might hire a private investigator to see what else you’ve been lying about.”
McMahon added that taking these steps will benefit you and your family in the long term.
“Life doesn’t end with divorce. Having an amicable divorce in which both parties come to a mutually agreed-upon arrangement will make post-divorce life much, much easier,” he said.
