The defendant driver asserts he did not see the motorcycle approaching the intersection, however two witnesses heading in the same direction as the truck assert they were able to see the motorcycle approaching the intersection. There is also witness testimony that the truck driver did not stop when making the left turn. Another witness’s testimony confirms that the motorcycle driver, in a tucked down riding position, changed lanes from the inside to the outside lane when approaching the intersection where the passenger bus was starting to turn left. The case was pending in the 19th Judicial Circuit in St. Lucie County, Florida. The case settled days before for $1,500,000.
“This was a very difficult case. Overcoming bias of speed and recklessness in motorcycle cases is very difficult, particularly when the operator is a young male on a performance type vehicle. In this case, we were able to show that the young man was not reckless and overcome the inherent juror bias,” said Robert Zimmerman, partner of Baker and Zimmerman.
