Media, PA Drug Lawyer Pushes For Changes To License Suspension Legislation

Before last year, those who lost their licenses due to a DUI charge would have the date of reinstatement extended for every drug charge. The law changed but there is still room for improvement.

Before last year, when someone lost their license due to a DUI or DWI charge, the date it could be reinstated may have been extended if they got into more trouble with the law for a drug-related crime – even if that charge had nothing to do with driving.


Arik Benari, a Media, PA drug lawyer from The Benari Law Group argues why he thinks this isn’t a good precedent: “There is no question that DUI or DWI charges are serious. However, there is a problem with someone not being able to get their license back for over a decade when they haven’t had a DWI charge in nine years. Taking away someone’s license is effectively taking away their abilities to have jobs, visit family, and seek treatment.”


Last year, Pennsylvania Governor Tom Wolf changed the legislation for anyone who gets a DUI moving forward, but it did not retroactively change the penalties for those who have already had their licenses suspended.

“What the government said is that they knew the law was wrong, they knew it was impacting people negatively, and they were going to change it – and they did,” the Media, PA drug lawyer said. “What they didn’t do was correct the wrong that was already done. They washed their hands of the law, but there are thousands of people still dealing with it.”


There is a growing movement to get those who have lost their licenses due to this law reinstated and back on the road.
