Understanding how a probate court process works will enable executors and relatives of the deceased to better deal with how an estate plan unfolds, Californian Attorney Sam Price said this week.

The Founder of Price Law Firm, APC, in Redlands, CA, explained that probate is the process in which the administration of a person’s estate is managed to completion. An executor will usually be cited in a will to act as administrator of the probate process.

The Estate Planning Attorney said that when someone dies, their assets are reviewed by a probate court. The court acts to deliver a final ruling on the distribution of these assets.

Mr Price said: “A court’s starting point will be to review documents of the person’s estate plan or will, and the executor will apply to the court clerk to formally begin the process.” 

The will is filed simultaneously, and the court will review it, determine its validity and rule on it. Once agreed upon, the court admits the will to probate, legally confirming the will as valid and the guiding document on how a person’s assets should be distributed to beneficiaries. It also gives the executor the legal power to act on behalf of the deceased.

Mr Price said the executor could then get the process underway. This covers overseeing the assets, paying off any debts against the estate and issuing a final, personal income tax return on behalf of the deceased. 

The executor will seek the probate court’s authorization to distribute any remaining assets to beneficiaries. The court’s role is to ensure the executor acted reasonably, in accordance with the law and the obligations of the estate have been fulfilled.

Mr Price said that the court would then officially close the estate.

However, where the person has died without making a will – otherwise called intestate – then the probate court will effectively step in and appoint an administrator to manage the estate.

The administrator will face the same tasks as an executor and identify legal heirs to the estate. The probate court, Mr Price emphasized, will review the assets, who are the rightful heirs and how these assets will be distributed.

He urged executors to seek professional advice from an estate planning attorney if they were unsure of the probate process and what a probate court does to ensure their time is spent efficiently and they fulfil their responsibilities to the letter of the law.
